By way of this petition, the petitioner has made a request to direct the appropriate authority for transferring him to the open prison. 2.

Ms. Mhatre, learned APP submits that the petitioner is convicted for the offences punishable under Sections 302, 394 and 449 read with Section 34 of the Indian Penal Code. Therefore, his request for transfer cannot be acceded to.

Since the petitioner is convicted for the serious offences punishable under Sections 302, 394 and 449 read with Section 34 IPC, we are of the opinion that the decision of the State Government not to transfer him to the open prison is in consonance with the relevant rules. 4.

Hence, no case is made out. Petition stands rejected. 5.
