The Applicants herein have filed these applications for prearrest bail apprehending their arrest in Crime No. 204 of 2019 registered with with Jaikheda Police Station for the offences under Section 143, 145, 147, 332, 353, 506 of Indian Penal Code r/w. 3(e) of Prevention of Damage to Public Property Act, 1984.

The case of the prosecution in brief is that on 8.12.2019 the elections of village panchayat Parner were in progress. The first informant, Sunil Patil who was on patrolling duty had visited the polling booth. A large crowd had gathered within the radius of 100 meters of the polling booth. It is alleged that when the Complainant instructed the crowd to move away, the Applicant others abused and threw stones at the police personnel. The first informant has alleged that he had sustained injury in the course of the scuffle. He therefore lodged the FIR against the Applicant and others, pursuant to which the aforesaid crime came to be registered.

The nature of injuries sustained by the complaiant are simple in nature. The Applicants were granted interim bail and they have not misused the same. Learned APP states that the presence of the Applicants is not required for the purpose of investigation. In view of the said statement and also considering the nature of accusation leveled against the Applicants, in my considered view, this is a fit case to grant pre-arrest bail. Hence the order.
i) In the event of arrest of the above named Applicants in Crime No. 204 of 2019 registered at Jaikheda Police Station, the Applicants be released on furnishing P.R. Bond in the sum of Rs.20,000/-
(Rupees Twenty Thousand Only) each with one or two solvent sureties in the like amount;
ii) The Applicants shall not interfere with the witnesses, or tamper with the evidence in any manner;
iii) The applicants shall keep the Investigating Officer informed of their current address and mobile contact numbers, and /or change of residence or mobile details, if any, from time to time; .
Applications are accordingly disposed of.
