Respondent is a foreign company in terms of Section 2 (i)(f), the arbitration in question would be an international commercial arbitration. If that be so, in view of provisions of Section 11 (12) read with provisions of section 29A (6), it would be appropriate for the petitioner to approach the Supreme Court. (See Cabra Instalaciones Y Servicios,S.A. vs Maharashtra State Electricity Distribution Company Limited, (2019 SCC OnLine Bom1424).

The petition is accordingly disposed of with liberty to the petitioner to approach the Apex Court in appropriate proceedings. 3.
