This petition takes an exception to the order dated 2 January 2019 passed by the respondent No. 1 District Magistrate and Collector, Pune.

2.

By the order impugned, the respondent No. 1 directed the Executive Magistrate and Tahsildar, Upper Pimpri Chinchwad and Mushi to take the possession of the properties mentioned in the Application filed by the respondent No. 2.

On 31 January 2019, this Court passed the following order: "1.

At the outset, Shri Nargolkar, the learned Counsel for the respondent Bank submits that the possession in respect of item nos. 1 and 3 has already been taken by the Bank.

2.

Shri Godbole, the learned Counsel for the petitioner submits that the petitioner will give a proposal of settlement to the Bank within a period of four days. The respondent bank to consider the said proposal and revert on 15 February 2019.

3.

It is made clear that no order has been passed on interim relief."

The petitioner has not amended the petition, inspite of the statement that the Bank has already taken possession of properties in question. It appears that petitioner is not interested in prosecuting the present petition.

Petition is disposed of.
