IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION INTERIM APPLICATION NO. 384 OF 2024 IN ANTICIPATORY BAIL APPLICATION NO. 3301 OF 2023 Emaduddin Kabiruddin Shaikh ..Applicant

Versus

State of Maharashtra ..Respondent _____ Mr. Shabbir A. Shora for Applicant.

Ms. Mahalakshmi Ganapathy, APP for State/Respondent. _____ CORAM :- SARANG V. KOTWAL, J.

DATE :- 6 FEBRUARY 2024 P.C. :- 1.

The Applicant was granted anticipatory bail vide the order dated 04.01.2024 passed in A.B.A.No.3301 of 2023 in connection with C.R.No.225 of 2023 dated 07.08.2023, registered at Shahunagar police station, U/s.420 r/w. 34 of the I.P.C. This order was passed on the submissions made by the learned counsel for the applicant that the applicant would deposit Rs.1,40,000/- within a period of one week from the date of that order i.e. from 04.01.2024. The said amount was to be deposited in the Registry VINOD BHASKAR GOKHALE VINOD BHASKAR GOKHALE Date: 2024.02.07 11:21:39 +0530

of the Metropolitan Magistrate'

s Court at Bandra. This was the precondition for availing of the said order.

2.

This interim application is preferred for extension of the time to comply with the said condition. Learned counsel for the applicant submitted that, due to financial constrains he could not arrange for the amount of Rs.1,40,000/- immediately. But now he is in a position to arrange for that amount and to deposit it within a period of two weeks before the same Court. 3.

Considering the submissions made by the learned counsel for the applicant, I see no harm in extending the period by two weeks for deposit of the said amount.

4.

Hence, the following order.

O R D E R

i) The Applicant is permitted to deposit the amount of Rs.1,40,000/- in the Registry of the Metropolitan Magistrate'

s Court at Bandra, within a period of two weeks from today; in connection with the above subject matter.

ii)Rest of the conditions mentioned in the order dated 04.01.2024 passed in A.B.A.No.3301 of 2023 are maintained.

iii)The interim protection which was extended by order dated 04.01.2024 for a period of one week is extended from today for the period of next two weeks.

iv)With this observation, the application is disposed of.
