1.
This is an application for cancellation of bail. The respondent No.2 was granted bail in C.R. No. I-193 of 2015 for offences under Section 307, 323, 504, & 506 of Indian Penal Code (for short "IPC"). The applicant was arrested on 25th August, 2015 and by order dated 12th October, 2015, the applicant was granted bail.
2.
The original complainant has preferred this application for cancellation of bail. I have perused the impugned order dated 12th October, 2015. More than five years have lapsed, after the respondent was set at liberty. The order dated 12th October, 2015 Sajakali Jamadar
1-Appln-76-2016.doc mentions that the applicant was in custody from 25th August, 2015 and the allegation against him is that he had pointed out Katta (revolver) towards the complainant. The weapon was not recovered. No purpose would be served by keeping the accused in custody. The offences were registered under Sections 307, 323, 504 & 506 of IPC. While granting bail the Court had also taken note of the fact that there were antecedents against respondent No.2. I do not find any reason to interfere in the order dated 12th October, 2015. Hence, the application stands rejected and disposed of accordingly.
