Mr. Arote, learned counsel for the Applicant states that during the pendency of this Application, the main accused has been granted bail and that the Applicant wishes to file fresh Bail Application before the Sessions Court on the ground of parity. Hence, under instructions, he seeks leave to withdraw the Application. Leave is granted. Bail Application stands dismissed as withdrawn. It is made clear that this Court has not gone into the merits of the matter. In the event fresh Application is filed before the Sessions Court on the ground of parity, the same shall be decided on its merits.
