DATED : 15th NOVEMBER, 2021 P.C:- The applicant was granted protection from arrest in C.R.No. 0014/20 registered with Karkamb police station which invoke the relevant provisions of Food Safety and Standards Act, 2006. The applicant was arraigned as Accused no.5 along with 10 other accused persons. The interim protection in favour of the applicant operate since 12th February 2020.

It is not the case of the learned APP that the applicant has not co-operated with the investigation and in fact, the submission of the learned APP is to the effect that the report of analysis has been received and the substance has been tested to be adulterated. In any case, the prosecution shall now be ready for institution of charge-sheet.

2/2 3 ABA 372-20.doc In such circumstances, since it is not the case of the prosecution that the applicant has either misused his liberty or failed to render his co-operation to the investigation, the applicant is entitled to be released on bail in the event of his arrest subject to the following conditions :-

O R D E R

(a) In the event of his arrest, the Applicant - Santosh Badade in connection of C.R.No.0014/20 registered with Karkamb police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(c) The Applicant shall make himself available as and when required by the Investigating Officer.
