2] Admittedly the original applicant-respondent No.3 herein is a disabled lady and was posted away from her place of residence. She claimed post at Panvel near the place of her residence. The original applicant-respondent No.3 was already holding post at Panvel. The request of the original applicant for giving regular posting at Panvel has been
wp.1739-2017 considered favourbly. It has been directed to issue necessary orders within one month from the date of the decision of the Maharashtra Administrative Tribunal. The petitioner herein claims that he has been unnecessarily displaced. There are other three posts of same cadre available at Panvel and he can be accommodated at Panvel. It is open for the petitioner to tender appropriate representation to the State Government and the State Government may consider such representation after considering the administrative exigencies and in accordance with law, as expeditiously as possible and preferably within 8 Weeks from the date of presenting such representation.
3] We do not find any substance to interfere in the impugned order by exercising our extra ordinary jurisdiction under Article 226 of the Constitution of India. No interference is called for in the Order passed by the Maharashtra Administrative Tribunal. The petition being devoid of merits is accordingly dismissed.
