Having heard learned counsel for the petitioner and learned APP for the State, we deem it convenient to dispose of this petition by directing the learned JMFC, 5th Court at Naupada, Thane to decide the petitioner's miscellaneous application being OMA 50 of 2010 as expeditiously as possible and preferably within a period of four weeks from the date of receipt of this order. Ordered accordingly. 2.

It is made clear that we have not gone into the merits of the matter and learned JMFC shall decide the petitioner's miscellaneous application on its own merits and in accordance with law. 3.
