Heard. This application is entertained as investigating agency having not adhered to the statement made on 12.1.2015 that charge-sheet would be filed before 30.1.2015. 2.

At the hearing of this application learned APP submitted that investigation is complete and charge-sheet would be filed tomorrow.

Having regard to the same and the offences for which the Applicant is charge-sheeted is not exclusively punishable with death and /or imprisonment for life nor the facts reveals any particular circumstance for not exercising discretion in favour of grant of bail in as much as the incident as the fact and Megha 1 of 2

924_ba_279_15.doc circumstances of the case reveals that incident has arisen due to a quarrel occurred on the count of first informant questioning Applicant for beating the neighbour of the first informant Suraj Rajbhar, the application is allowed.

Resultantly, the Applicant is directed to be released on bail in C.R. No.I-697 of 2014 of Nalasopara Police Station, on furnishing P.R. Bond in the sum of Rs.50,000/-(Rupees Fifty Thousand only) with one or two sureties to make up like amount and subject to conditions that after his release the applicant shall (i) stay outside the area of Nalasopara Police Station; (ii) inform his place of abode to the I.O. and shall attend the police station of such area on every alternate Monday for a period of two months and thereafter on every first Monday in between 11:00 a.m. to 12:00 p.m. until further order; (iii) not indulge in activity of tampering, threatening, coercing, intimidating or pressurizing the prosecution witnesses in any manner; and (iv) not misuse the bail granted vide this order for fleeing away or for committing any further offence.
