Heard the learned counsel for the parties.

This application is preferred by defendant for condonation of 38 days delay in filing First Appeal challenging the decree dated 9.9.2014 passed by Civil Judge, Senior Division Pune in Special C.S.No.1314 of 2012.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

(a) This Hon'ble Court be pleased to condone the 38 days delay which occurred in filing the present First Appeal and the Appeal is heard on merits."
