Mr. Aiyaz Khan, learned counsel for the applicant seeks leave to withdraw this application as appeal against acquittal has been inadvertently filed in this Court. Learned counsel for the applicant states that the aforesaid proceeding ought to have been filed before the Sessions Court.

In that light of the matter, learned counsel for the applicant, therefore, requests that leave may be granted to applicant to withdraw this application with liberty to file the application before Sessions Court. 3.
We, accordingly, dismiss this application as withdrawn with liberty as prayed for.
