This is an Application filed under Section 438 of Criminal Procedure Code, 1973 for anticipatory bail.

The applicant is apprehending her arrest in Crime No.350 of 2022 registered at Jaikheda Police Station, Nashik (Rural) for the offences punishable under Sections 306 r/w 34 of Indian Penal Code, 1860. 3.

I have heard the learned counsel for the applicant and the learned APP for the Respondent-State.

The deceased was the husband of the present applicant. According to the prosecution, due to harassment caused by the present applicant and other co-accused, the deceased had committed suicide on 31/11/2022 by hanging himself.

I have perused the FIR. The main allegations are against the son of the deceased, who is co-accused in the present crime. It appears that he was 1 / 2

Vina Khadpe 27-aba-322-2023.doc asking the deceased to sell the land owned by him and to give him money for starting construction business. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail.

ORDER

(i) Anticipatory Bail Application is allowed.

(ii) In the event of arrest of the applicant in Crime No.350 of 2022 registered at Jaikheda Police Station, Nashik (Rural) for the offences punishable under Sections 306 r/w 34 of Indian Penal Code, 1860 she shall be released on bail on executing P.R. bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall attend the concerned police station as and when called by the investigation officer and shall cooperate in investigation.
