Heard the learned counsel for the Applicant-Accused and the learned APP for the State.

Non-bailable warrant was issued against the Applicant on the ground that the Applicant was consistently absent before the Appeal Court and has not furnished the surety though he was enjoying the bail order. 3, The learned counsel for the Applicant submits that Applicant undertakes to regularly attend the Trial Court and shall also furnish the surety within six weeks, the non- bailable warrant issued against the Applicant may be quashed. 4.

In the interest of justice and having taken note of the undertaking given V.A. Tikam 1/2

APL 126 of 2018 Applicant that he shall regularly attend the Trial Court, the following order is passed:

(i) Within three weeks from today, the Applicant shall deposit the costs of Rs.10,000/- before the Learned Trial Court;

(ii) Within two weeks from today, the Applicant shall furnish surety within six weeks to the satisfaction of Trial Court on the same conditions as has been imposed by the Trial Court at the time of release the Applicant on bail. If the surety to the satisfaction of the Trial Court is not furnished, the order of issuance of warrant shall held in operation; (iii) The assurance/ undertaking given by the Applicant that the Applicant shall regularly attend the Trial Court is accepted/ recorded. The nonbailable warrant as ordered by the Learned Trial Court shall be stayed for a period of two weeks.
