This is an Application for bail. The Applicant along with the co-accused has been charge-sheeted for the offence punishable under Section 364A, 384, 341, 344, 323, 504, 506 read with Section 34 of the Indian Penal Code, arising out of the Crime No.982 of 2021 registered with Shirur Police Station. 2.
I have heard the learned counsel for the Applicant and the learned Additional Public Prosecutor. Perused record. 3.
The prosecution case is that the complainant was abducted and was assaulted and was threatened with life on account of a monetary dispute between the parties. Insofar as the N.S. Kamble page 1 of 3
offence of kidnapping under Section 364A is concerned there are no allegations against the Applicant attributing any role to him. The only allegation against the applicant is that he had assaulted the deceased.
4.
The learned Additional Public Prosecutor states that the investigation is practically complete and the charge-sheet will be filed shortly.
5.
Considering the nature of the allegation against the present Applicant, I do not find that there is any justification to detain the Applicant behind the bar during the trial. 6.
In the result, the following order is passed.
ORDER
(i) The applicant be released on bail, on executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties, in the like amount.
