This Application is filed seeking quashment of F.I.R. No.66 of 2012 registered with Neral Police Station at Neral for the offences punishable under Sections 406, 420, 467, 468, 471 read with Section 34 of the Indian Penal Code, 1860.

Mr. Shaikh, the learned APP having taken instructions from the concerned officer states that after completion of investigation into the said F.I.R., Investigation Officer is proposing to file 'C' Summary report. In Shivgan

*2* 6-APL-133-2013.doc support of his submission, he placed on record report dated 19.1.2016 by the Assistant Police Inspector, EOW, Raigad-Alibag. The same is taken on record.

In the light of above, Applicant's grievance would no more survive.

So far as the Respondent No.2/Original Complainant is concerned, he is always at liberty to file protest petition before the concerned Magistrate. Suffice it to observe that the learned Magistrate shall not dispose of 'C' Summary report without hearing Respondent No.2/Original Complainant.

Subject to above, Application is dismissed.

Interim order, if any, stands vacated.
