This application is preferred by Insurance Company for condonation of 97 days delay in filing the First Appeal challenging the judgment and award dated 24.8.2011 passed by Commissioner for Workmen's Compensation and Judge, 3rd Labour Court, Mumbai in Application (WCA) No.605/C-195 of 2007.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, Mohite 1/2

A) Civil Application is allowed in terms of prayer clause (a) which reads thus:
