The application for bail preferred by the applicant was rejected on merits by Sessions Court by order dated 7th February 2019. Present application is preferred for temporary bail on the health ground of applicant's mother. The certificate has been annexed to this application.

Learned APP submitted that the applicant ought to have preferred application before Sessions Court on the ground agitated in this application. He has moved directly before this Court. 3.

In the circumstances, the applicant seeks leave to withdraw this application with liberty to prefer application before Sessions Court on health ground of his mother. In view of submission, this application is allowed to be withdrawn with liberty to applicant to prefer application for temporary bail on the health ground of his
