We have heard the learned counsel for the petitioners and the learned counsel for the respondents.

The dispute it appears is arising out of the conditions of the tender. Considering the nature of the dispute and the disputed question of fact involved, it would not be appropriate to exercise jurisdiction under Article 226 of the Constitution of India. The petitioner may approach the competent civil court or any other appropriate forum as may be permissible in law. In that event, all contentions are kept open.
