This is an application for bail in connection with C.R.No.500 of 2018, registered with D.N. Nagar Police Station, Mumbai, for the offences punishable under Sections 376, 504, 506 read with 34 of Indian Penal Code. First Information Report ("FIR", for short) was lodged on 7th November, 2018. The case of the complainant is that she was working in a Beauty Saloon of the co-accused from April 2018. It is alleged that the co-accused Santosh Shetty was trying to come close to her and the conduct of the co-accused was reported to the applicant by the

rpa 2/3 927-ba-356-19.doc complainant. It is further alleged that on 18th August, 2018, the co-accused had forcefully sexually assaulted the complainant. FIR was lodged on 7th November, 2018. Applicant was arrested on 8th November, 2018. The only role which has been attributed to her is that she did not support the complainant. She had instigated the alleged act committed by the co-accused. Investigation is completed and charge-sheet has filed. There are no other antecedents against her. In the circumstances, case for grant of bail is made out.

Hence, I pass the following order:

:: O R D E R ::

(i) Criminal Bail Application No.356 of 2019, is allowed;

(ii) Applicant is directed to be released on bail in connection with C.R.No.500 of 2018, registered with D.N. Nagar Police Station, Mumbai, on his furnishing P.R.Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;

((v) Bail Application stands disposed of.
