For the reasons recorded in the order dated 09-02-2015, an ad-interim direction in terms of Section 438 of Code of Criminal Procedure has been passed in favour of the applicants.

Learned APP, upon instructions from the investigating officer, has submitted that, as 1/3
ordered, the applicants have deposited the amount of Rs. 75,960/- with the investigating officer towards the value of the stolen property.

The learned counsel for the applicants has submitted that the applicants have no objection of investigating officer paying the said amount to the first informant, as a price of the property said to have been stolen. Having regard to said submission, it is difficult to perceive of there being any need of custodial interrogation of the applicants for completion of the investigation.

Resultantly, the application is allowed.

The investigating officer of C.R. No. 12 of 2015, registered with Marine Drive police station, Mumbai for offence punishable under Section 380 read with 34 of Indian Penal Code is hereby directed that in event of arrest of the 2/3
applicants in connection with the crime in question, they be released on bail upon furnishing P.R. Bond in sum of Rs. 30,000/- (Thirty Thousand) each with one or two sureties to make up like amount and subject to abiding of the conditions imposed vide the ad-interim order dated 09-02-2015. The application stands disposed of.
