Having heard both sides, we find that the Petitioner who has sought admission to the degree course, namely, Mechanical Engineer degree course from the academic year 2015-2016 with the Respondent No. 4 - College is awaiting a scrutiny and verification of the caste certificate.

It is stated, on instructions, by the learned AGP that the matter is referred for Vigilance Enquiry and a report from that Cell and it is expected that the Vigilance Cell will submit its report within three months. The Vigilance Cell take some time to
20-WP1603-16.DOC complete the enquiry and submit a report, whereafter the scrutiny committee and if there are any recommendations and findings contrary to the interest of the student will complete the further steps but all this will be concluded within a period of six months from today.

We accept these statements made by the learned AGP, on instructions, as undertaking to this Court. We clarify that within this period of six months everything must be concluded, namely, the Vigilance Enquiry, submission of the report by the Vigilance Cell and its consideration by the Committee whereafter it may or may not issue a notice to the Petitioner to appear before it and pass a reasoned order. However, we clarify further that in no case we will extend this period of six months.

Having granted six months time to the Committee, we except Respondent No. 4 - College not to disrupt the eduction of the Petitioner, provided the Petitioner clears all examinations and comply with the academic requirements. He would be thus allowed to continue his studies till the committee concludes the matter. (G. S. PATEL, J.) (S. C. DHARMADHIKARI, J.)
