Counsel for Respondent No.3, Mr. Deshmukh states, cost as directed by this Court on 11th September, 2023, is yet to be paid. The amount was to be paid before 15th September, 2023. The order dated 15th September, 2023 reads as under:

"1. The petition is pending since the year 2015. Order dated 17/08/2023 reveals that matter was adjourned at the request of learned counsel for Respondent No.3 subject to payment of cost of Rs.5,000/-. It is seen that Respondent No.3 has not yet deposited the cost of Rs.5,000/-.

2. Learned counsel for Respondent No.3 states that cost will be deposited within two days. Statement is accepted.

3. Learned counsel for Respondent No.3 once again seeks time. By way of indulgence and final opportunity, stand over to 15/09/2023 subject to cost of Rs.15,000/- to be paid on or before the next date with Kirtikar Law Library." Shivgan

2/2 901-aswp- 513-2015.doc Mr. Deshmukh states, Respondent No.3 would abide by any condition this Court would place. Respondent No.3 is directed to pay Rs.25,000/- as cost to Kirtikar Law Library. Mr. Deshmukh states, the amount will be paid by tomorrow. If the amount is not paid before 5.30 p.m. tomorrow and an affidavit of compliance is not filed on or before 15th March 2024, the Petition will stand allowed without further reference to this Court.

Stand over to 4th April, 2024 if as directed above, cost is paid and affidavit is filed.
