The Applicants are seeking Anticipatory Bail in connection with C.R.No.727/2020 registered with Pimpri Police Station, Pune. In connection with this C.R.No.727/2020 of Pimpri Police Station, the learned Additional Sessions Judge, Pune vide its order dated 30/01/2021 had rejected their Anticipatory Bail Application i.e., Criminal Bail Application No.4952/2020.

The Applicants had also approached Division Bench of this Court by way of Writ Petition No.401/2021. The order dated 24/08/2021 passed by the Division Bench of this Court in Writ Petition No.401/2021 directed the investigation in C.R.No.727/2020 registered with Pimpri Police Station to be transferred to EOW, Unit II, Navi 1/2

P.H. Jayani 03 ABA346.2021.doc Mumbai and the investigation was directed to be conducted by the EOW, Unit II. Therefore the jurisdiction of the trial Court as well as the Sessions Court has now changed.

Considering this change in circumstance, learned counsel for the Applicants pray for withdrawal of this Application with liberty to approach the appropriate jurisdictional Sessions Court for the relief of Anticipatory Bail in connection with the subject matter of this present Application in these changed circumstances. Learned APP as well as learned counsel for the Intervenor have no objection for such liberty being granted to the Applicant.

In view of the above, following order is passed :- (a)The Application is allowed to be withdrawn with liberty to the Applicants to approach the appropriate Sessions Court with the same relief of Anticipatory Bail which is claimed in this Application.

(b)With this liberty, the Application is allowed to be withdrawn and is disposed of.
