The applicant is apprehending his arrest in Crime No. 12 of 2022 registered at Vani Police Station, Nashik Rural for the offences punishable under Sections 392, 395, 324, 323, 504, 506, 188, 170, 171, 37(1), 135 of the Indian Penal Code.

I have heard the learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the complainant. 4.

According to the complainant, on the date of incident, which took place on 24 January 2022, the present applicant and other co-accused MJ Jadhav 1 / 2

29-ABA-342-22.odt assaulted him by fighter, fist and kick blows. It is alleged that in the incident, the complainant had sustained injury to his nose. 5.

I have perused the First Information Report. It appears that on the date of alleged incident dispute arose between the complainant and the applicant on account of parking of vehicle. The alleged injury sustained by the complainant is not attributed to the present applicant. 6.

The learned APP submits that the applicant is involved in two more crimes. However, they are of the year 2015 and 2018. 7.

Considering the overall facts and circumstances of the case, interim order passed by this Court dated 9 February 2022 is hereby confirmed subject to deposit Rs. 50,000/- by the applicant with Tata Memorial Hospital, Parel, Mumbai.
