After arguing the matter at length, learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. Learned counsel for the applicant, upon instructions, submits that the applicant would surrender before the Magistrate on or before 14th February 2018. The application of the present applicant shall be considered by the learned Magistrate on it's own merits with the aid of Proviso of Section 437 Cr.P.C. without being influenced by the withdrawal of this application.
