None appears for the Petitioner. Heard the learned APP for the State. By this petition, the Petitioner seeks directions to the Respondent to arrest accused in C.R. No. 17 of 2015. The said CR was registered by BKC Police Station at the instance of the Petitioner wherein the Petitioner has alleged commission of the offence punishable under sections 376, 363, 366, 328, 506 read with 34 of IPC and section 66E of the IT Act.

The learned APP, on instructions, makes a statement that investigation into the said FIR is complete and it was found that the complaint is false and accordingly on 15th March 2015, B-summary report is filed before the concerned learned Metropolitan Magistrate, 9th Court, Bandra. Statement accepted.

In above circumstances, the relief claimed in the writ petition does not survive and therefore, writ petition is dismissed. The remedy of the Petitioner is to contest the B-Summary report before the concerned Magistrate.
