1) After hearing the learned Counsel for the applicant at length, when this Court was not inclined to grant any relief, the learned counsel, on instructions, seeks leave to withdraw the application with liberty to file a fresh application for bail before the trial Court, if the trial pertaining to CR No. 139/2013 registered with Dahisar Police Station, Mumbai does not commence within a period one year from today.

Leave and liberty granted.

2) The record reveals that the applicant is arrested on 28/3/2013 and since then he is in jail. In view of the same, the concerned Additional Sessions Judge, seized of the trial pertaining to CR

3) The application is dismissed in the aforesaid terms.
