Learned counsel for the applicant seeks leave to withdraw the application with liberty to file an appropriate proceeding seeking his discharge before the trial Court in view of the Hon'ble Supreme Court's Judgment in the matter of V. D. Roy v/s. Kerla, reported in 2004 (4) Crimes 196 and the Notification dated 21.06.1990.

Accordingly, the application is dismissed as withdrawn. If an application for discharge is filed, the learned Sessions Judge to decide the same expeditiously.
