Heard learned counsel for parties on civil application seeking condonation of delay in filing the appeal. We find that delay of 83 days in filing the appeal is satisfactorily explained. Accordingly, delay is condoned. Civil Application No.491 of 2015 stands disposed of.
CIVIL APPLICATION NO.492 OF 2015 IN FIRST APPEAL (ST) NO.3452 OF 2015 Applicant Mr.Rahul Mehta i/by KMC Legal Venture for Applicant. The Applicant seeks stay of execution of the award. On 9th February 2015, this Court granted conditional stay. Learned counsel for Applicant submits that entire amount has been deposited before the Trial Court on 18th March 2016. The receipt to that effect has also been filed. In view of the aforesaid, Civil Application No.492 of 2015 is disposed of by observing that until further further orders, Respondent no.1 shall not be entitled to withdraw the amount so deposited.
