This is an application for anticipatory bail in connection with C.R.No.I-127 of 2019, registered with Hill Line Police Station, Ulhasnagar, District-Thane, for the offences punishable under Sections 395, 397, 363, 323, 504 and 506 of Indian Penal Code ("IPC", for short) and under Sections 37(1) and 135 of Bombay Police Act.

First Information Report ("FIR", for short) was lodged on 23rd May, 2018, by one Sagar Pawar alleging that on 14th May,

rpa 2/2 910-aba-279-19.doc 2018, he was assaulted by eight to ten persons and taken to another place, where again he was assaulted.

In the FIR, he has referred the name of one person viz. Pintya, who instructed to assault the complainant. The contention of the applicant is that he has been falsely implicated in this case and he is not Pintya. While filing charge - sheet, he is being impleaded by referring him as Pintya. However, on perusal of the statement of Akash Nikam, the name of the Pintya is referred to as Pintya Fullore, which shows the involvement of the applicant in second part of the incident. Considering the nature of evidence, no case for grant of anticipatory bail is made out. Anticipatory Bail Application is rejected.
