This is an application under Section 439 of the Cr.P.C. for bail in CR No. 248/2017 dated 15.9.2017 registered with Kherwadi Police Station, Mumbai under Sections-376, 354, 506(2) read with 34 of the Indian Penal Code. 2.
Heard the learned counsel for the applicant and the learned APP. for the State. Perused the record. 3.
The record indicates that the allegations of commission of offence as contemplated under Section 376 are made against the accused No.1 Abhishek Pande and
2 /3 there is sufficient material on record against him to show his complicity in the present crime. As far as present applicant is concerned, it is the allegation against him that he facilitated Abhishek Pande for commission of offence under Section 376 on the first occasion and subsequently on 8.9.2017 has committed an offence under Section 354 of the I.P.C. against the victim. Thus, prima facie, allegations against the applicant are as contemplated under Section 354 of the I.P.C. are made.

In view thereof, the applicant can be released on bail. Hence, the following order.
a) The applicant be released on bail in CR No. 248/2017 dated 15.9.2017 registered with Kherwadi Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
b) After his release from Jail, the applicant shall attend the concerned Police Station on every first Monday of the month between 11.00 a.m. to 1.00 p.m.
c) The applicant shall attend all the dates before the
3 /3 Trial Court unless precluded on medical reasons. d) Any two consecutive defaults in complying with the afore stated conditions will attract the provisions of cancellation of bail.
e) The applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
