At the outset, Mr. Cama, learned Counsel appearing for the Petitioner, having taken instructions from his client, seeks leave to withdraw the writ petition without prejudice to his rights and contentions and with liberty to approach the Sessions Court for the reliefs claimed in the present petition. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn without prejudice to the rights and contentions of the Petitioner and is dismissed as such. 2.

In the event, the Petitioner makes such an application within two weeks from today, the learned Sessions Judge shall dispose of the same as expeditiously as possible and at any rate within the period of four weeks from the date of its filing. Needless to state that Sessions Judge shall hear Respondent No.3 before passing any patilsr 1 / 2

effective order.

It is expressly made clear that Sessions Judge shall decide any such application of the Petitioner independently on its own merits and present order shall not be construed as expression of any opinion on merits of the matter.
