Heard. This is an application under Section 438 of Cr.P.C. The applicant herein is arrested in Crime No.15 of 2015 registered with Kalwan Police Station for the offence punishable under Section 394 of IPC. 2.

By an order dated 17.2.2015, this Court had granted interim relief in favour of the applicant.

Perused the papers of investigation. It is apparent on the face of the record that on the same set of circumstances, N.C. No.33/2015 was registered on 23.1.2015. On the set of same allegations Crime No.15 of 2015 is registered. In

Mhi 2 ABA-190-15.sxw view of this, the applicant deserves pre-aerrest bail. 4.

The observations made hereinabove are prima facie in nature and the Sessions Court shall not be influenced by the same for the purpose of deciding application for quashing of FIR or discharge application or at the time of trial.

O R D E R

(I) In the event of his arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

Application is allowed and disposed of.
