The applicants are the accused of accepting the sum of Rs.16,00,000/- plus Rs.30,00,000/- from the complainant and it is alleged that the amount of Rs.16,00,000/- was handed over to the applicants for being invested in American Dollars, which would entail a proft. As far as the amount of Rs.30,00,000/- is concerned, it is passed on as a business friendly loan, under the Memorandum of Understanding dated
2/3 13 ABA-346-22.doc 07/10/2020 signed by the applicants and the complainant, with an understanding that the borrowers will return the sum of Rs.3,90,000/- on every month to the creditor. 2.
The applicants were directed not to be arrested and on 06/06/2022, a statement was made to the effect that the amount of Rs.18,42,702/- has been passed over to the complainant and the learned A.P.P. was asked to verify the statement.

The transaction referred to in the complaint is a business transaction and on the last date of hearing, the complainant was asked to tender to the Investigating Offcer the details of the bank account and the entries made therein so the averment in the complaint that she has parted with the amount of Rs.16,00,000/- can be ascertained. The learned counsel for the complainant fairly states that in the bank account, the amount of Rs.16,00,000/- is not clearly refecting though there are stray entries about the some amount being advanced to the applicants.

In the wake of the aforesaid, the learned A.P.P., on the instructions of the Investigating Offcer Mr.Mahendra Lone who is present in the Court, states that the applicants have rendered co-operation in the investigation agency and their
3/3 13 ABA-346-22.doc custody is no more required for further investigation. Hence, the following order.
: ORDER :
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.I-482 of 2021 registered with Nayanagar Police Station, applicant No.1-Minaj Raju Mujawar and applicant No.2-Naushad Raju Mujawar shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each, with one or two sureties of the like amount.
(c) The applicants shall report to the concerned police station as and when called for.
(d) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Offcer and should not tamper with evidence.
