This is an application for transfer of Criminal Application No.460/2005 filed by the respondent pending on the file of Chief Judicial Magistrate, Nashik to the file of Chief Judaical Magistrate, Nagpur or any other Court at Nagpur.

Perused the record.

The applicant is the husband of respondent. The respondent has filed the said application under Section 125 of the Cr.P.C. claiming maintenance from the applicant. The

2 /2 12-appln. 671-06 record indicates that the respondent is house wife and the applicant is a gainfully employed person. As a matter of fact if the petition is transferred to Nagpur Court, it will cause undue harassment and financial burden to the respondent.

3. After taking into consideration the facts of the present case, this Court is of the view that no case for transfer of Criminal Application No.460/2005 filed by the respondent herein is made out.

Application is accordingly rejected.
