MONDAY, 29TH FEBRUARY, 2016 P.C. :
1.
The petitioners in this Writ Petition, namely, Dr. Rutuja V. Bhuyar and Dr. Swaleha Mujawar pray that they be granted identical relief as the petitioners in the earlier petitions (WP No.9487 of 2015 & Others) but by relying upon the certificates, copy of which is at Annexure-G at pages 69 and 70 of the paperSRP 1/3
book. They submit that that qualifies and fulfills the requirements of the Medical Council of India's Regulations. 2.
We are none to certify such compliance and it is for the National Board of Examinations to look into the the necessary certificate and document which would be taken as proof of attendance to the extent of not less than 80 per cent. 3.
All the more, when we find that the certificate says that Diploma in Clinical Pathology course and the Diploma in Psychiatry course where the petitioners worked as Junior Residents involve lecture teaching and practical work. Therefore, whether the certificates, copies of which are at pages 69 and 70 of the paper-book, certify both is an aspect which can be verified by the National Board of Examinations, but pending such verification and scrutiny, let the petitioner be allowed to take the counselling scheduled on 3rd March, 2016. The Board, if it finds that the petitioners have successfully completed the counselling and are eligible for the admission, shall then complete the verification and scrutiny within eight weeks from the date the petitioners are certified as eligible for provisional admissions. SRP 2/3
The admissions will be treated as provisional subject to the verification.
4.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
All concerned to act on an authenticated copy of this order. G.S. PATEL, J.
