This is an application for condonation of delay in preferring an appeal challenging the conviction of the applicant/ accused for offences punishable under Sections 376, 452 and 506 of the Indian Penal Code. The delay occasioned is 45 days. Heard the learned Advocate appearing for the applicant/accused as well as the learned APP appearing for the State.

11-APPA-175-2017-.doc The reasons for delay in lodging the appeal is penury of the applicant/accused and the fact that he was constrained to seek legal aid from this court. This amounts to sufficient cause for condoning the delay. Hence the order :

ORDER

i) The application is allowed.

ii) The delay in filing the appeal is condoned.

iii) The application is accordingly disposed of.
