Heard the learned counsel for the parties.

This Civil Application is preferred by claimant for restoration of First Appeal (ST) No.20751 of 2011 which was dismissed in view of conditional order dated 17.9.2012 passed by Registrar (Judicial-II), High Court, Appellate Side, Bombay. Considering the submissions made by the learned counsel for the Applicant and the averments made in application, I am satisfied that the applicant has made out a case for allowing this application.

Applicant is directed to pay cost of Rs.750/- to the respondent within four weeks from today, Mohite 1/2

27 caf1839-14.doc failing which Civil Application shall stand dismissed without referring back to the court. Hence, following order:

a) Delay in preferring Civil Application is condoned.

b) Order dated 17.9.2012 passed by learned Registrar (Judicial-II), High Court, Appellate Side, Bombay is set aside and four weeks time is granted to the appellant to remove all office objections in First Appeal (ST) No.20751 of 2011, failing which Civil Application shall stand dismissed without referring back to the court.

c) Applicant either to pay sum of Rs.750/- to the respondent and or to deposit the same in the Registry of this court within four weeks from today, failing which Civil Application shall stand dismissed without referring back to the court. d) Civil application stands disposed off accordingly.
