1] This is an application for modification of condition imposed upon the applicant by an Order dated 10th September 2014 passed by this Court in Criminal Application No.568 of 2014, thereby directing the applicant to attend all dates before the concerned Magistrate. By the said Order, the concerned Magistrate has been directed to keep hearing of the case in question at least once in a week.

2] The learned counsel for the applicant submitted that, the charge has been framed, however, till date the trial is not proceeded and the same is adjourned for at least more than hundred times. 1/2

appp.113-2018.doc 3] In view thereof, the said condition is relaxed and the applicant is directed to attend the trial court on relevant dates i.e. when the Trial Court seeks actual presence of the applicant for conducting trial, recording evidence of witnesses and pronouncement of Judgment. 4] Application is allowed in the aforesaid terms.
