This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 29 of 2023 registered at Baramati City Police Station, Pune for the offences punishable under Sections 307, 324, 323, 504, 506, 143, 147, 149 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State and perused the first information report. Kanchan P Dhuri 1 / 2

Prima facie, the incident does not appear to be pre-meditated. I have perused the injury certificates of the injured. The injuries are simple in nature. The learned APP submits that the applicant No.1 is involved in one more crime. However, considering the facts and circumstances of the case, I am inclined to release the applicants on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant No.1 - Vikrant @ Kalu Ashok Avdute and applicant No.2 - Gachhami Sanjay Gaikwad be released on bail in Crime No. 29 of 2023 registered at Baramati City Police Station, Pune for the offences punishable under Sections 307, 324, 323, 504, 506, 143, 147, 149 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount. (iii) The applicant No.1 shall attend the concerned police station once in a month i.e. on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
