By the impugned order dated 24 September 2014, the learned Additional Judge, Small Causes Court and CJSD, Pune rejected the application Exhibit 5 filed by the plaintiff under Order 39 Rule 1 & 2 of Civil Procedure Code. Today, when the matter was called out nobody was present for the parties. Upon perusal of the case status (online) it appears that the Civil Suit No.506/2013 out of which impugned order has arisen, was itself disposed of on 20 December 2016. In view of this, the Appeal from Order stands dismissed as infructuous.
