IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CONTEMPT PETITION NO.2 OF 2017 Vijay Kondayya Manthena
...Petitioner
vs.
Sarjerao Jagdale and Ors.
...Respondents
---- Mr. S. G. Kudle for the Petitioner.
Mr. Inderpal Singh for the Respondent Nos.1 and 2. Mr. F. R. Shaikh, APP for the Respondent-State. ---- CORAM : B. P. DHARMADHIKARI & REVATI MOHITE DERE, JJ.
DATE : 09/01/2019.
P.C.:
.
Heard respective counsel. Perused the order dated 13/6/2014 in ABA No.1120/2014.
2.
The order does not show any statement either by respondent No.1 or respondent No.2 that no FIR is registered against the petitioner. It appears that trial Court was not convinced about registration of any such FIR and therefore has passed the said order. Trial Court therefore has not verified the position even from the APP who was appearing before it. 3.
However, it is a matter of record that on 18/6/2014 the petitioner got relief from this Court.
4.
In this situation, we do not find that the Respondent Nos.1 and 2 could be said to have made any incorrect statement. We are not inclined to intervene in extra ordinary jurisdiction. The petition is accordingly disposed of.
