Mr.Joshi, the learned counsel for the appellant on instructions seeks leave to withdraw the appeal, as the appellant/Insurance Company, has taken a decision not to pursue the appeal.

In such circumstances the appeal is dismissed as withdrawn, with no order as to costs. Interim relief, if any, stands vacated.

The appellant shall be entitled to refund of Court Fees as per rules.

The amount of Rs.25,000/- deposited before this Court along with interest, if any, shall be made over to the Motor Accident Claims Tribunal at Kolhapur. The Tribunal shall pass appropriate order in respect of the same.
