This application is filed seeking withdrawal of the amount deposited by the Appellant-Insurance Company in the office the Commissioner for Employees Compensation and Judge, Labour Court, Mahad, District-Raigad under the Workmen'

42-ia-1763-2023.doc Workmen's Compensation Act. There is already finding recorded against the Appellant. This Court finds that the hearing of the appeal may take some time. It would not be proper to keep the amount lying in the office of Commissioner for Employees Compensation and Judge, Labour Court, Mahad, District-Raigad. The applicants are the dependents of the deceased employees. Hence the following order:

ORDER

i) The applicants are entitled to withdraw the 50% of the amount deposited with accrued interest, if any. Giving an undertaking that if in case the appeal is allowed there shall be re-deposited the amount within six months thereafter.

ii) The Commissioner, Labour Court, Mahad to allow the withdrawal of the amount. The remaining of 50% amount shall be deposited in the Nationalised Bank till the disposal of the appeal.
