Heard learned Counsel for the petitioner.

By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 16.01.2014 passed by Principal Judge, Family Court, Mumbai on Interim Application No. 135/2013 (Exh.22) in Petition No. A-2713 of 2011 directing the petitioner to pay sum of Rs.3,000/- per month to the wife and minor son Bhavik from the date of application i.e. 10.07.2013.

On 20.06.2014, the learned counsel for the petitioner after taking instructions from his client made a statement that petitioner would pay Rs.40,000/- within four weeks before the Family Court to the Respondent Wife.

2 wp 3435-14=.doc The learned counsel for the petitioner submits that he tried to contact his client but there is no response from him. Hence, it is not possible for him to make a statement that order dated 20.06.2014 is complied or not.

Considering this fact and non compliance of order dated 24.06.2014, Writ Petition stands dismissed for non prosecution.
