Perused investigation papers. Applicants were arrested on 11/01/2019 in Crime No. 239/2018 registered with Radhanagari Police Station Police Station, Dist. Kolhapur for offence punishable under sections 306 r/w 34 of the Indian Penal Code. Having perused the investigation papers, I hardly notice any convincing reason to order further detention of the applicants.

2 903.371.19 ba.doc There is no material to infer satisfaction of ingredients of section 306 of the Indian Penal Code, particularly when it was not within the knowledge of the applicants that their conduct may drive the victim to commit suicide. That being so, following order: (A) Applicant be released in Crime No. 239/2018 registered with Radhanagari Police Station Police Station, Dist. Kolhapur on furnishing P.R. bond in the sum of Rs. 10,000/- each with one surety in the like amount. (B) Applicants to attend Investigating Officer as and when directed by him.

(C) Applicants shall not influence witnesses or tamper with evidence.

Application stands disposed of.
