In this Writ Petition, in view of the prayers made, no notice is required to be given to respondent No. 1, who is accused in R.C.C. No. 766 of 2007 (new R.C.C. No. 165 of 2010) pending in learned Judicial Magistrate First Class, 4th Court, Thane. 3.

The petitioner has filed Criminal case on the ground of forgery of will dated 3rd March, 1996 of his mother where respondent no. 1, i.e., petitioner's brother is made accused under sections 467 and 420 of Indian Penal Code. He submitted that the matter is pending before the learned Judicial Magistrate First Class

514.WP531_2019.doc since last 11 years. He has 67 years old and respondent is 70 years old, hence it is to be expedited.

As both the parties are senior citizens, the learned Judicial Magistrate First Class, 4th Court, Thane is hereby directed to expedite the matter on or before 30th September, 2019. The complainant is directed to produce this order before the learned Judicial Magistrate First Class, 4th Court, Thane on the next date and the accused is also to be made aware of this order. 5.

Writ Petition is disposed of.
