This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 6 of 2019 registered at Velha Police Station, Pune for the offences punishable under Sections 376(d), 354, 452, 504, 506 r/w. 34 of Indian Penal Code and Sections 3, 4, 6, 8, 12 of the Protection of Children from Sexual Offences Act, 2012.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The bail is sought on the ground of parity. The learned Counsel for the applicant in support of the said ground has placed on record order passed by this Court dated 31 January 2022 in Bail Application No.3097 of 2021. By the said order, this Court has released co-accused Dattatray Sanas on bail.

I have perused the statement of the victim. According to the victim, on the date of incident, which took place on 18 December 2018, the present applicant and co-accused Dattatray Sanas came to her house and committed forcible sexual intercourse with her. The allegations against the present applicant and the co-accused - Dattatray Sanas appears to be identical. In that view of the matter, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Ananta Dhondiba Karanjkar be released on bail in Crime No. 6 of 2019 registered at Velha Police Station, Pune for the offences punishable under Sections 376(d), 354, 452, 504, 506 r/w. 34 of Indian Penal Code and Sections 3, 4, 6, 8, 12 of the Protection of Children from Sexual Offences Act, 2012, on furnishing P.R.
